State territorial planning and construction inspection at the Ministry of the Environment (Construction Inspectorate), responding to civil complaints Vilnius district Skaidiskės village residents' complaint, checked the legality of the construction permit document (SLD). After checking the documents, it became clear that the SLD was issued to build a structure for the purpose of communication (telecommunications) networks in the village of Skaidiškės, Nemėžys ward, Vilnius District Municipality committed serious violations.
Officials of the Building Inspection, in accordance with the Law on Territorial Planning and Construction State Supervision and in order to objectively assess the circumstances indicated in the complaint, conducted an inspection of the building (radio communication tower) under construction for the purpose of communications (telecommunications) networks at the address Senasis Minsko pl., Skaidiškiu k., Nemėžio sen., Vilnius r. weekly After visual inspection and measurements, the inspectors determined that the tower was built according to the project. However, there were reasonable suspicions that irregularities could be committed during the issuance of the SLD, so it was decided to check the legality of the documents.
After checking the legality of the SLD, it became clear that the tower is being built on a plot of land whose main target land use is agriculture. According to the description of the content of land use methods, transmission towers, radio communication structures, communication repeaters and other engineering structures can be built on plots of other purposes, the method of use of which is the plots of the territories of transportation and engineering communications service facilities.
In addition, the decisions of the project, according to which the SLD was issued, contradict the general plan of the area level, part of the territory of the Vilnius district municipality. According to the solutions of the functional zoning drawing of the general plan for the development of territories, the plot of land falls into the territories of services and one- and two-apartment residential buildings, and there are no planned areas for transportation and engineering communications service facilities, that is, the possibility of building a communication tower in such areas is not foreseen.
After assessing all the circumstances established during the investigation, the Construction Inspectorate will soon apply to the court for the annulment of the SLD, and for the assessment of the qualifications of the construction participants - to the Chamber of Architects of Lithuania and the Construction Sector Development Agency.
