The telecommunications company "Telia Lietuva" did not prove to the higher court that the tender of the Lithuanian gas transmission system operator "Amber Grid" for 1,6 mln. worth of computer workplaces for rent and maintenance was carried out in a non-transparent manner, so the winner must be re-elected. The company was the last in the competition.
On January 19, the Court of Appeal of Lithuania rejected Telia Lietuvos' appeal, in which it requested the annulment of the first instance court's unfavorable decision.
"The court of first instance made a reasonable conclusion that the company has no interest in contesting the defendant's decision. Such a conclusion was sufficient to reject the claim", - reads the ruling of the Court of Appeal.
The Vilnius District Court dismissed Telia Lietuvos' lawsuit last October, however, in the company's opinion, such a decision was made after improperly assessing all the circumstances of the case.
In the appeal, Telia Lietuva also wanted to demand evidence - the EIT Decisions application, but the court stated that this would be contrary to the Law on Public Procurement.
The competition for the Epso-G group's service for companies ended last July, and its winner Amber Grid announced the information technology company Baltnetos komunikaciós, which offered 1,6 million. euro price. The second place was taken by "EIT Sprendimai", while "Telia Lietuva" remained last and sought to cancel the tender results.
In Telia's claim, Amber Grid stated that Baltnetos komunikaciós offers unsuitable equipment, therefore it cannot be considered the winner of the tender - it would use adapters that could be made in countries unfriendly to Lithuania - Russia, Belarus, China or North Korea, they can be operated from these countries, which may be considered a threat to national security.
Telia Lietuva also stated that the owner of the Fujitsu computer manufacturer offered by EIT Sprendių is registered in China, and this violates the terms of the tender.
"Amber Grid" disagreed with the claims of "Telia Lietuvos", the latter appealed to the court.
Telia Lietuvos business customer manager Danielis Karpovičius previously told BNS that the company strives for transparency.
