It is proposed to allow entities performing non-economic commercial activities to build, reconstruct structures or facilities on a leased plot of state land without paying the same tax as those performing commercial activities, for example, building shopping centers.
The amendments to the Land Law proposing to legalize this were registered by Vytautas Bakas, a member of the "Vardan Lietuvos" faction of the Seimas Democrats.
According to him, at the moment, the Land Law does not distinguish between persons engaged in commercial and non-commercial activities, so the residents faced the problem that for the permission to install parking spaces for several cars near the apartment buildings from March 1. the tax payable to the state is the same as for the implementers of commercial projects.
"At the end of last year The Seimas adopted amendments to the Land Law, which established the procedure for the right to build structures on leased plots of state land and for compensation to the state for such a right. The regulation was necessary because part of the tenants of state land, without changing the purpose of land use, built or reconstructed structures and the state was not compensated for this, for example, even when a new shopping center was built on the site of an old administrative building. However, now residents can no longer afford the opportunity to install parking lots," says V. Bakas, the initiator of the amendment to the law.
Due to such a problem, the presidents of the apartment house owners' associations of this city approached the member of the Seimas elected in the single-mandate district of Alytus. Parliamentarian V. Bakas invited to a meeting both representatives of apartment house owners' associations, representatives of the Alytus municipality administration, council members, and land managers.
"I am grateful to the chairmen of Alytus apartment house owners' associations for raising the issue. Residents who operate through community organizations, for example, through communities, associations, cannot be equated with entrepreneurs who carry out commercial activities. It is important to balance the interests of these groups, taking into account their capabilities and the goals of public land use. After all, for many residents, especially the elderly or those with disabilities, parking lot next to the house, it is not a matter of profit or luxury, but a matter of necessity", says V. Bakas, MP, deputy chairman of the Democratic Union "Vardan Lietuvos".
According to the member of the Seimas, the property of the state and municipalities must be managed in a way that meets the interests of the entire society, giving priority to the public interest over private interests, both in terms of land use goals, purpose, and land use conditions.
The registered draft amendment to the Land Law provides for an exception to the calculation of remuneration for the possibility of building and reconstructing buildings or facilities on a leased plot of state land for non-economic commercial entities.
The amendment to the law is submitted by Seimas members Zenonas Streikus, Linas Kukuraitis, Algirdas Butkevičius, Zigmantas Balčytis, Rūta Miliūtė, Laima Nagienė, Vilija Targamadzė, Domas Griškevičius, Rima Baškienė, Tomas Tomilinas, Algirdas Stončaitis, Saulius Skvernelis.
