Vilnius and Gargžda construction companies "HSC Baltic", "Hidrostatyba" and the Tauragė company "Uliksas" coordinated their actions while participating in the tender for the reconstruction of the buildings of Santaras Clinic Children's Hospital, the court ruled.
On Thursday, the Lithuanian Court of Appeal rejected the companies' appeal and upheld the decision made by the Vilnius District Court in January. The courts satisfied the claim of Veikmės statyba, a construction company indirectly controlled by the Icor concern, and annulled the decision of Santaras clinics regarding the tender winner.
"The decision of Uliks not to submit a guarantee of the validity of the offer cannot be explained in any other way than concerted action, when it became known that it won the first place, while the more expensive offer of the related HSC Baltic and Hidrostatybos remained in second place. It is clear that "Uliksas" would not have made such a decision if, for example, Veikmės statyba, which remained in third place, was entered in second place. The behavior of "Uliks" can be assessed as illogical", the ruling of the Court of Appeal reads.
According to the courts, "Uliksas", "HSC Baltic" and "Hidrostatyba" are related because they are all controlled by Jonas Dumašius, who directly or indirectly owns the shares of the companies.
The tender procedures for the reconstruction of the children's hospital's child development center and pediatrics and surgery buildings were suspended last November at the request of Veikmės statybos. Competition Santara clinics announced last May.
During the first round of tenders, the companies "Uliksas" and "Re&Re" offered the lowest price - 13,39 million. euros. After they left, "HSC Baltic" and "Hidrostatyba" offered the lowest price - 14,2 million. euros.
Veikmės statyba (14,32 million euros), LitCon (14,74 million euros), Conresta (18 million euros), Merko statyba and Merko eitus (17,65 .18,59 million euros), "Irdaiva" (XNUMX million euros), "Eikos statyba" and "Eika" (20,37 million euros) and "Versina" and "Kautras real estate" (21,44 million euros).
